The Defamation Bill is now coming to the end of its passage through Parliament. On 16 April 2013 it will be back before the Commons on “ping pong”, the stage at which the Commons considers new amendments made by the House of Lords. As Inforrm noted here, in a post examining the detail of the Amendments, there were 16 Lords Amendments. Conservative MP and former Solicitor-General, Sir Edward Garnier, has sought to remove Amendment 2.

The Libel Reform campaign has condemned the proposal to remove the clause which would require corporations to show financial damage before they can sue for libel. The Media Reform Coalition argues that the clauses are crucial: “Without a requirement to show damage, there is a danger that companies can use libel courts as an arm of their PR operations, simply suppressing what they don’t want in the public sphere”.

Defamation, regulation, and internet policy in this week’s media law round up, including judgments in Cairns v Modi and KC v MGN Ltd ([2012] EWCA Civ 1382) [media summary here, PDF] and Ismail & Anor v News Group Newspapers Ltd [2012] EWHC 3056 (QB) (31 October 2012).

The libel trial in Mengi v Hermitage began on Wednesday 31 October 2012 before Bean J. The trial was also heard on 1 November 2012 and will resume on 6 November 2012.

The theme of privacy continued to dominate media law discussion last week, as a French court granted an injunction prohibiting further publication of the Duchess of Cambridge photographs in France. Press Gazette reported that the editor of the Irish Daily Star, Michael O’Kane, was suspended following his decision to publish the photographs.

The Inforrm Law & Media round up is back from a summer break, slightly ahead of the start of the new legal term. These regular weekly round ups contain summaries of relevant legal and parliamentary proceedings and media content, as well as listings for the week ahead. They are compiled from various legal and news sources, but additional suggestions and content is always welcomed, particularly in relation to defamation, privacy, contempt of court and media regulation, although other media and communication legal topics will be included.
